As it is in v1.9, Tywin has Ice at the beginning of the ACoK bookmark, and he and his successors keep it even after Robb wins the war. And then, after beating the Iron Throne, Robb has to then wait for a time when the Westerlands are independent and declare war on them to get Ice back. I remember that in previous versions of the mod (like back when Valyrian Steel Swords were traits instead of artifacts) Robb would automatically get Ice back as part of his "Enforce Demands" at the end of his independence war. An as for lore-justification, I think it's highly unlikely that Robb wouldn't demand the return of his house's ancestral sword upon defeating the Lannisters.
